Endorsement Terms and Conditions

These terms and conditions of endorsement apply where you choose to apply as an organisation or as an individual practitioner to the National Skills Academy for Social Care (‘the Skills Academy’).

The term ‘you’ refers to an organisation or an individual practitioner or organisation and the term ‘us’ refers to ‘the Skills Academy’.

The Skills Academy reserves the right to change or update the terms and conditions without prior notice.

Any revisions of these endorsement terms and conditions will be notified to endorsed organisations or practitioners by email.

1. Endorsement Application

The National Skills Academy for Social Care’s Endorsement for Recognition, Excellence Award and Endorsed Practitioner, are different categories as reflected in the endorsement fees.

On submission of an application, organisations and practitioners are thereby expressing a willingness to be bound by the terms and conditions as set out in this document.

No category of endorsement can be ‘lent’ nor transferred to any other organisation or individual, or benefits, offers or services used by any other than the named organisation or practitioner.

All appeals against a National Skills Academy for Social Care Review Panel decision must be submitted to the National Skills Academy for Social Care within one month of receiving the panel’s decision.

The Skills Academy will allow appeals based on procedural grounds, where the applicant believes that the Skills Academy has not followed the correct process and where the Skills Academy can see that there is a possibility that the Skills Academy has not followed the correct process.

Appeals will not be allowed that are based on substantive grounds, where the applicant disagrees with the decision of the appeal.

If an appeal against a review panel decision is submitted then a fee is payable at the point of submission.

This payment must be made by cheque.

If the appeal is upheld then the fee will be returned in full. If the appeal is not upheld then the fee will not be returned.

The decision of the National Skills Academy for Social Care’s Appeals Panel is final and no further appeals to the same claim can be lodged.

All appeals should be sent to appeals@nsasocialcare.co.uk, detailing the procedural grounds for appeal.

2. Endorsement Validity

All successful applications for Recognition or the Excellence Award enable the organisation to trade as a National Skills Academy for Social Care Recognised Provider or a Centre of Excellence for three years (subject to annual renewal fees and annual updates being submitted, see below) after which a full resubmission is required.

All successful applications to become an Endorsement for Practitioners are valid for 12 months.

All successful applications to become an Endorsed Practitioner enable the individual to trade as a National Skills Academy for Social Care Endorsed Practitioner for one year after which a full resubmission if required.

Both forms of endorsement are for fixed terms unless specifically stated otherwise and starts on the day that the practitioner or organisation is notified of a successful application.

Organisations applying for the Excellence Award will be visited by a Skills Academy reviewer.

3. Payment

You will receive an email to confirm receipt of payment. Payment should be made by cheque or BACS. If you have any difficulties please call the endorsement team on 0207 397 5624 or email endorsement@nsasocialcare.co.uk.

If endorsement payment remains outstanding we will notify you by telephone, email or letter.

An application will be processed once receipt of payment has been confirmed.

Fees are non-refundable. If applicants believe that there has been a failure of process which has resulted in their application not meeting the criteria they can submit their complaint via the appeals process as discussed above (in 1. Endorsement Application).

4. Personal details

All information provided by you to us must be true and accurate at the point of applying. In the event of a change of circumstances such as moving jobs, change of contact details or any other change that will affect your profile, you must update your profile through your account on the NSASC website, submit in writing or by telephone.

5. Data protection

Should an individual or organisation become endorsed, some contact details will be published on the Skills Academy’s website.

This information will form part of a list of recognised or excellent providers that anybody may access.

Any personal information you provide to us will be kept securely and in accordance with the Data Protection Act (1998) and any other applicable data protection legislation.

6. Renewal

A practitioner will have to resubmit for endorsement after a year. It is not possible to renew endorsement for a practitioner.

An organisation will have to re-submit a endorsement application after the term of 3 years unless otherwise specifically stated.

All endorsed organisations will have to renew their endorsement status at the end of their first and second year of endorsement.

This involves informing the Skills Academy of any substantial change of structure or process.

This is to allow the Skills Academy to assess whether the organisation is putting in place measures to maintain quality assurance.

Payment is usually taken in order to coincide with the annual renewal fee the Skills Academy expects all endorsed organisations to complete an annual update form which can be downloaded from the Skills Academy website.

7. Breach of Endorsement

The National Skills Academy for Social Care reserves the right to rescind endorsement under certain conditions.

For example, by poor conduct, either professionally or personally you bring the reputation of the Skills Academy into disrepute, we reserve the right to temporarily suspend or permanently cancel your endorsement.

As stated previously (see 1. Endorsement Application) neither category of endorsement can be ‘lent’ or transferred to any other organisation or individual, or benefits, offers or services used by any other than the named organisation or individual.

If this is proved to be the case, the Skills Academy reserves the right to immediately cancel your endorsement without refunding any part of your endorsement fee.

8. Disclaimers and exclusion of liability

Although care is taken to ensure that the information on the Skills Academy website is accurate and up to date, we cannot accept any responsibility for mistakes or omissions.

In particular, any articles in our archives which may be out of date.

Although we will do our best to ensure the quality of the information we publish directly, we enter into no express or implied conditions, warranties, terms or representations regarding the quality, accuracy or completeness of the information.

The training providers on this list have been through a rigorous self-evaluation and independent review process.

This has focused on the systems and processes they have in place for the development and delivery of learning opportunities related to adult social care.

The National Skills Academy for Social Care endorsement process does not investigate the actual content of the learning programmes offered by these providers.

It is considered to be the professional responsibility of the organisations to keep up to date with developments in the sector which will influence such content.

Should failure to deliver to the latest specifications emerge, the National Skills Academy for Social Care will not be held responsible for the event or the consequences of such failure.

The Skills Academy does not check the financial status of the training providers that become endorsed through the Skills Academy.

It is the responsibility of the third party contracting with the provider to verify the provider’s financial stability.

The Skills Academy will not accept any liability for any loss or damage incurred as a result of a third party contracting with a training organisation or individual that has been endorsed by the Skills Academy.

9. Links

The Skills Academy website may contain links to other websites not operated or controlled by us.

If you use these links, you will leave our website.

These links are provided for convenience only and do not constitute any endorsement by us of organisations or individuals promoted on the linked websites, their products or services, unless explicitly stated by the Skills Academy.

10. Intellectual Property Rights

Organisations notified of a successful application for Recognition, the Excellence Award or to become an Endorsed Practitioner, and in receipt of confirmation certification, are permitted to use the appropriate logo of the National Skills Academy for Social Care as demonstration of their endorsement.

Guidance will be provided as to which is the appropriate logo.

Use of the logo must be in line with the branding guidelines issued by the Skills Academy.

The Skills Academy will take appropriate action to protect the integrity of the endorsement and branding and guard against misuse.

The intellectual property rights (including, without limitation, copyright and trade marks) in all materials on the Skills Academy (including, without limitation, text, images and plans) are owned by the Skills Academy unless otherwise stated.

11. Governing Law

These terms and conditions shall be interpreted in accordance with English law and all disputes shall be subject to the exclusive jurisdiction of the English Courts.
